Terms Of Service
1. Scope and Provider
These Terms of Service apply to all orders placed by consumers and business customers in our online shop. The contract is concluded with:
EvMa Creative UG (haftungsbeschränkt)
Goethestraße 21
06749 Bitterfeld-Wolfen
Germany
Managing Director: Yuliia Voitsikhovska
Commercial Register: Amtsgericht Stendal, HRB 37955
Email: help@catzeq.com
A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business or profession. Deviating terms of the customer will not be recognised unless we expressly agree to them in writing.
2. Our Products
We sell crochet kits, yarns and textile products, as well as accessories, materials and tools for crochet, handcraft and DIY projects. Product images are for illustration. Slight differences in colour may occur due to screen settings and natural variations between yarn dye lots. Such differences do not constitute a defect.
3. Conclusion of Contract
The presentation of products in our online shop is not a legally binding offer but an invitation to place an order.
By clicking the button "Order with obligation to pay" (or a similarly worded button), you submit a binding offer to purchase the goods in your shopping cart. Before submitting your order, you can review and correct all entries at any time.
Immediately after your order is received, we send you an automatic email confirming receipt. This confirmation does not yet constitute acceptance of your offer. The contract is concluded when we send you a separate order or shipping confirmation by email, or when we deliver the goods.
4. Contract Language and Storage of the Contract Text
The contract language is English. We store the contract text after conclusion of the contract. You will receive the order details and these Terms of Service by email. You can also view and print these Terms of Service on this page at any time.
5. Prices
All prices stated in our shop are final prices in euros and include the statutory value added tax. Any shipping costs are shown separately in the product description and during checkout.
6. Delivery Area and Shipping
We currently deliver exclusively to addresses in the Netherlands. Orders are shipped from our warehouses in Germany or France.
We offer two shipping options:
Standard Shipping: free of charge. Delivery time is approximately 4 to 5 business days.
Insured Express Shipping: 4.95 EUR. Delivery time is approximately 2 to 3 business days. This option includes shipping insurance.
Delivery times begin on the day after payment is received (for prepayment) or on the day after the contract is concluded (for all other payment methods). If the last day of the delivery period falls on a Saturday, Sunday or public holiday at the place of delivery, the next business day applies.
If an item is temporarily unavailable, we will inform you immediately. If an item is permanently unavailable, we may withdraw from the contract and will refund any payments already made without delay.
For consumers, the risk of accidental loss or damage to the goods passes to you only when the goods are handed over to you.
7. Payment
The payment methods available to you are shown during checkout. If you choose a payment method provided by a third party (for example PayPal, credit card or a buy now pay later service), the terms and conditions of that provider also apply. Payment is due immediately upon conclusion of the contract unless otherwise stated at checkout.
8. Retention of Title
The goods remain our property until full payment has been made.
9. Right of Withdrawal
Consumers have a statutory right of withdrawal of 14 days. Full details, including the withdrawal period, how to exercise the right and the consequences of withdrawal, can be found in our separate Cancellation Policy (Widerrufsbelehrung), which also contains a model withdrawal form.
10. Damage During Transport
If goods are delivered with visible transport damage, please report this to the delivery company where possible and contact us as soon as possible. This helps us make claims against the carrier or the transport insurance. Failure to report damage has no effect on your statutory rights, including your warranty rights.
11. Warranty
The statutory warranty rights apply. For consumers, the warranty period for new goods is two years from delivery. If an item is defective, please contact us at [your email address] and include a short description and, if possible, a photo of the defect.
Normal wear and tear, as well as damage caused by improper use, washing or care contrary to the care instructions, is not covered by the warranty.
12. Liability
We are liable without limitation for damage resulting from injury to life, body or health, for intentional or grossly negligent breaches of duty, under the Product Liability Act and where we have given a guarantee.
In the case of slightly negligent breaches of essential contractual obligations (obligations whose fulfilment makes the proper performance of the contract possible in the first place and on which you may regularly rely), our liability is limited to the foreseeable damage typical for this type of contract. Any further liability for slight negligence is excluded.
13. Dispute Resolution
We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board. If you have a complaint, please contact us directly by email. We will do our best to find a fair solution with you.
14. Governing Law
The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). For consumers, this choice of law applies only to the extent that it does not remove the protection granted by mandatory provisions of the law of the country in which the consumer has their habitual residence (for example the Netherlands).
15. Final Provisions
If any provision of these Terms of Service is or becomes invalid, the validity of the remaining provisions shall not be affected.
